General Provisions
These General Terms and Conditions (hereinafter also the “T&Cs”) govern the relationship between the contracting parties, namely the supplier (hereinafter the “Supplier”) on the one hand and, on the other, the client, who may be either a consumer or a business (hereinafter the “Client”).
To the fullest extent permitted by the mandatory provisions of generally binding legislation, any legal relationship with a Client acting as a business that is not expressly covered by these T&Cs or by the contract between the Supplier and the Client shall be governed by the relevant provisions of Act No. 513/1991 Coll., the Commercial Code, as amended, and by related legislation.
Should there be any discrepancy between these T&Cs and an individual contract, the wording of the contract shall prevail. By placing an order, the Client confirms that they have read and agree to these T&Cs, including the complaints procedure, which forms an integral part of them, in the version valid and in force at the time the order is submitted.
The Client acknowledges that ordering any of the services offered by the seller does not grant them any right to use the registered marks, trade names, company logos or patents of the seller or of any other company, unless otherwise agreed in a separate contract in a specific case.
Any relationships and disputes arising under these T&Cs shall be governed exclusively by the applicable law of the Slovak Republic and shall be resolved through mediation.
These T&Cs are available on each of the seller’s websites, so they can be saved and archived.
The cost of using means of distance communication (telephone, internet, etc.) to place an order is charged at the standard rate, depending on the tariff of the telecommunications services used by the Client.
Supply Contract
An offer to conclude a supply contract is made when a prospective Client submits an order to the Supplier via the online interface, by email or by post. The service contract between the Supplier and the Client comes into existence only once the price of the services has been paid (hereinafter also the “Supply Contract”). The Supply Contract between the Supplier and the Client comprises the price, the service and the scope of the service set out in the order description, together with these T&Cs.
Withdrawal from the Contract and Refunds. The Supplier provides services only. Performance of the ordered services begins as soon as the price has been paid, and the Client agrees to this. As performance starts immediately after payment, the Supplier does not offer refunds, and the Client may not withdraw from a contract for the provision of services once provision of those services has begun.
Complaints Procedure. Clients may submit complaints by email to: info@etuls.com. Complaints will be dealt with within a reasonable time.
To the fullest extent permitted by law, any relationships and disputes arising under the Supply Contract shall be governed exclusively by the applicable law of the Slovak Republic and shall be resolved through mediation.
Security and Protection of Information
All personal data are treated as confidential. They will be used solely for the performance of the contract and for marketing activities and will not otherwise be published or disclosed to third parties, except where this is necessary for delivery or payment processing (disclosure of the name and delivery address). Personal data provided voluntarily by the Client for the purpose of fulfilling an order and for marketing activities are collected, processed and stored in accordance with the applicable laws of the Slovak Republic, in particular Act No. 122/2013 Coll. on the Protection of Personal Data and on amendments to certain acts, as amended. The Client consents to the Supplier collecting and processing these personal data for the performance of contracts and for the seller’s marketing purposes (in particular sending commercial communications, telemarketing and SMS) until the Client withdraws this consent in writing by notice sent to the Supplier’s address. Notice given electronically is also deemed to be in writing for this purpose. The Client has the right to access their personal data and the right to have them protected.
Prices
All prices are contractual. The prices shown in the online shop are always current and valid. Prices are final, i.e. they include VAT and any other taxes and charges the consumer must pay to obtain the goods; this does not apply to any delivery charges and similar costs. Promotional prices apply while stocks last or for the period specified.
The original price means the price at which the seller offered the goods or service in question, disregarding any bonuses, sales promotion campaigns and other discount offers in the e-shop it operates.
Payment Terms
The seller accepts the following methods of payment:
- payment in advance by bank transfer,
- payment via the bank’s online interface (online card payment),
- payment against an invoice with a due date (only where the conditions for granting credit are met),
- payment by credit card issued by a partner company offering instalment purchases.
Final Provisions
These General Terms and Conditions are valid and in force from 22.01. 2025. The seller reserves the right to amend the T&Cs without prior notice.
