Trademark registration in the USA

Registering a trademark in the USA is an important step in protecting the name, logo or other sign a business uses for its products or services. Before filing, you should check that the sign is sufficiently distinctive and does not infringe the rights of earlier owners.

When protecting a brand on the US market, you need to consider in particular the USPTO, evidence of use, office actions and the precise identification of goods and services. A well-prepared application can reduce the risk of oppositions, requests from the office or a later narrowing of the scope of protection.

The first practical step is a search. This helps establish whether similar or identical signs already exist. Although a search is not always mandatory, it often determines whether the application is filed as originally intended, the artwork is adjusted, the list of goods and services is changed or a more cautious strategy is chosen.

The second step is selecting the goods and services. A trademark does not protect a sign in general, but only for specific areas of business. The classes must therefore be chosen correctly and worded so that the protection matches both the current and the planned use of the brand.

Once the application has been filed, it is examined by the office and published. At this stage, the office may request further information, or the owner of an earlier mark may file an opposition. Requests and oppositions must be answered promptly and to the point; otherwise registration may be refused or restricted.
